Doctor convicted in Jackson death seeks release

The doctor convicted of involuntary manslaughter in Michael Jackson 's death asked a judge Friday to release him from jail pending his appeal.

Dr. Conrad Murray , who is serving a four-year jail sentence , said in a declaration that he should be released either on his own recognizance or on bail with electronic monitoring.

He said he is not a danger to society, will not flee the area, and wants to work to help support his seven children.

His lawyer, J. Michael Flanagan , said in the motion that Murray knows he cannot work as a doctor but would find other employment. He suggested the sentence and Murray's mode of confinement is extremely severe for a man with no prior criminal record.

He said Murray is being held in solitary confinement and is chained to a table when he meets with his lawyers. He also said Murray is extremely sorrowful about Jackson's death.

Jackson died in June 2009 from an overdose of the anesthetic propofol, administered by Murray. Flanagan conceded that Murray made some medical misjudgments but said he never intended harm to Jackson.

Murray's appeal has not yet been filed, but the motion offered a preview of some issues that will be raised, including the claim that Superior Court Judge Michael Pastor should have allowed testimony about Jackson's financial condition.

Flanagan said the exclusion of that evidence "seriously compromised the defendant's ability to demonstrate the desperate situation which was guiding the decisions and choices of both Mr. Jackson and Dr. Murray."

Murray appeared to be blaming Jackson for decisions that led to his death.

"Mr. Jackson was an uncooperative patient who made decisions and demands based upon his particular needs," said Flanagan. "One of which was his extremely precarious financial situation complicated by drug addiction. "

Flanagan also cited the judge's refusal to sequester the jury and the presence of cameras in the courtroom as appellate issues.

With Murray's appeal expected to take more than a year to move through the courts, the attorney said it would be unfair to keep him jailed in the interim.

Under sentencing guidelines, Murray is expected to serve no more than half of his sentence. The attorney said if he served his complete sentence he would not receive the benefits of a favorable appeal decision if his case was overturned.

A hearing on the motion was set for Feb. 24.

Sony Music confirms hack of Michael Jackson tracks

Sony says a number of Michael Jackson tracks have been stolen after its website was hacked.
The company will not confirm how many tracks or what material was taken in the online attack.
In 2010 Sony Music paid $250 million (£158m) to the late singer's estate for a seven-year deal for the rights to his remaining songs.
The first tracks came out with the release of a posthumous album called Michael in December that year.
The singer, who died in June 2009 at the age of 50, had recorded unreleased duets with artists ranging from the late Freddie Mercury and Black Eyed Peas singer will.i.am.
In April last year Sony's PlayStation Network was hacked and the company admitted that the personal details of more than 70 million people may have been taken.
The hack of Michael Jackson tracks is said to have taken place soon after that but has not been revealed until now.
The Sony Music site also hosts tracks by other artists including the Foo Fighters, Olly Murs and Avril Lavigne although it is still unclear whether they are affected.
Two men from the UK have appeared in court to deny computer misuse and copyright offences.
James Marks, 26 and from Daventry, and 25-year-old James McCormick from Blackpool, were arrested last May and are due to stand trial in January 2013.

No bail for Michael Jackson's doctor

A judge who presided over the trial of Michael Jackson's doctor refused on Friday to release him on bail, saying he would be a danger to any community where he might try to practise medicine.

Conrad Murray's lawyer asked for his release pending appeal of his involuntary manslaughter conviction, but Superior Court Judge Michael Pastor said he saw little chance that Murray would prevail in getting his case overturned.

Pastor made it clear that his view of Murray had not softened since he gave him a tongue-lashing and the maximum four-year sentence in the superstar's death. He suggested Murray hurt his own chances for freedom in a documentary interview broadcast after the trial saying use of the powerful anaesthetic propofol in the home was appropriate.
Jackson died in 2009 of an overdose of the drug that Murray administered in his bedroom as a treatment for insomnia. Expert witnesses testified they never heard of anyone administering the drug outside a hospital. "I didn't tell Dr Murray to give an interview for a documentary," the judge said. "When he did, I listened to it and saw it and I was concerned about his attitude toward the use of propofol in the home. What he believes scares me."

Pastor also believes Murray, who was born and raised in the Caribbean, would pose a flight risk. He said the doctor could go to a foreign country that might allow him to practise medicine, and anyone encountering him as a patient would be in danger .

Murray's team indicated that they would file paperwork for an appeal either yesterday or today. This morning I watched a Flanagan interview on 'The Early Show' this morning, and he outlined the defense's rationale for an appeal:

1. No jury sequestration
2. Michael's financial debt was not allowed to be discussed (showed desperation)
3. Couldn't subpena Klein, could only discuss his records
4. Issue of bottle in evidence that contains propofol--if it is 90% propofol, that would validate the infusion theory, if 100% propofol, couldn't have been an infusion.

He said there are several other issues as well, and that they will be discussed in the Appellate court. Yesterday during the post-hearing press conference he implied that Judge Pastor was biased against his team, he was overly harsh on Murray, and that his mind was made up prior to the hearing. He said something along the lines of "Pastor's actions should be evaluated by another court of law".

One other point of interest is that he said that they consider Murray to be in danger in the general prison population.

One of the next projects will be the re-release of Off The wall with the help from Quincy Jones . The plan is for Quincy to take charge of the project.

Another project is the re-release of the Bad album and a first time official release of the Bad World Tour on DVD. This would only be done with the help of the original crew who worked with Michael in the past.


The Immortal World Tour by Cirque du Soleil enjoys great success all around the world. There is an album featuring the soundtrack of the new Michael Jackson themed Cirque du Soleil show in Vegas.


Reports that Sony will release 10 albums of new material as part of their new deal with the Michael Jackson Estate have been confirmed to be false. The deal was made for 10 projects – not all of them feature never-before-released material. Part of the 10 project deal has already been released: This Is It , Vision DVD boxset and the new Michael album.

Also there are talks about a new duet album having Michael's and Freddie Mercury's voices on it. This is supposed to be produced by Queen this year :-)

Event at Burj Steps held to encourage people to get into fitness in an enjoyable manner

DUBAI — Michael Jackson’s hit song ‘Thriller’ can get anyone on their toes and move the shoulders. Set against the iconic backdrop of Burj Khalifa, a few thousand dancers grooved to the song at the first-ever dance extravaganza at Downtown Dubai on Friday. From zombie walks to well coordinated dance moves, the event saw high-energy action from every single participant.

“It was a one of a kind exhilarating experience. You are standing among several like-minded people and the backdrop of Burj Khalifa and the Dubai Fountain made things pretty amazing,” said dancer and marketing professional at Fitness First Sarah Bell.

Jointly organised by Emaar Properties and Fitness First, the dancers donned their dancing shoes and the Burj Steps, overlooking Burj Khalifa, came alive to a footloose dance spectacle.

Mark Botha, sales and marketing director of Fitness First said, “The whole point of the event was to encourage fitness as a community event. It was to encourage people to get into fitness as a lifestyle and the reason we didn’t keep the event as a flash mob is because we wanted people to know about it and take part,” said Botha. He added that fitness is not about boring walks on the treadmill, it can be highly enjoyable.

The dance gala featured both professional dancers as well as rank amateurs with a passion for dance and music. Fitness First choreographed the routine and taught their members the dance steps via social media channels and scheduled rehearsals.

Indian national Kunal Thakur said, “I enjoy dancing and I am a big time fitness freak. I have been working out for four years. The event was fabulous, the crowd was really energetic. You would think that people would not come in because it’s a Friday and the best part was everyone came in with their families and people really enjoyed themselves.
A lot of university students participated in the event as well. Besides, I love Michael Jackson. His style is one of my favourite dance moves, so it made the event a lot more enjoyable.”

A new single from BAD 25

I Just Can't Stop Loving You will be released as a single in June to promote Bad 25 with unreleased song "Don't Be Messin' Around" as a bonus track.

Twenty-five years after the phrase "Who's Bad" became a generation's cultural catchphrase, Epic/Legacy Recordings, in collaboration with the Estate of Michael Jackson, will celebrate the legendary album and record breaking BAD tour on September 18, 2012 with the release of a deluxe package, BAD 25, which includes three CDs, two collectible booklets, and features the first ever authorized DVD release of a concert from the record breaking BAD tour.

· The highlight of the package is the DVD of Michael's legendary July 16, 1988 concert at Wembley Stadium. The concert is not a compilation of performances, but rather one complete show, exactly as Michael performed it for Prince Charles, Princess Diana and the 72,000 fans who were in the audience for that night's sold out show. This show was one of the record-breaking seven nights played at the venue attended by more than half a million people – three times that many people tried to purchase tickets. The DVD was sourced from Michael Jackson's personal VHS copy of the performance as shown on the JumboTrons during the concert. This footage was only recently unearthed and is the only known copy of the show to exist. The visuals have been restored and the audio quality enhanced so that fans can share in the excitement of that famous night

· A CD of the re-mastered original BAD album

· A CD containing previously unreleased material recorded in Michael's personal studio at Hayvenhurst. This material includes early demo versions of songs from the album as well as demos for songs not included on the final album. On June 5 in the U.S. (June 4th ex-U.S.), Epic / Legacy Recordings will re-release the original first single from the album "I Just Can't Stop Loving You" as a CD Single with a previously unreleased bonus track from the BAD sessions, "Don't Be Messin' 'Round (demo)." This is a Wal-Mart exclusive CD single in the U.S. and will not be available digitally.

On June 26 a replica edition of the original 7" vinyl of this single with the original B-side "Baby Be Mine" will be made available to the world. The first single for BAD, "I Just Can't Stop Loving You," was originally released on 7" vinyl in 1987. The 7" single edit of the song has only been available on that original 7" vinyl until now.

Recently, Pepsi announced an exclusive global partnership with the Estate of Michael Jackson as part of its new "Live for Now" campaign. Starting this month, Michael Jackson and Pepsi fans in more than 20 countries around the world will experience this partnership in a variety of ways, including a retail campaign featuring one billion special edition Michael Jackson Bad 25 Pepsi cans, live events, and opportunities for fans to access special edition merchandise and new music from BAD.

The BAD album was the third Michael Jackson album produced by Quincy Jones and was originally released on August 31, 1987. It was monumental in many ways; Michael wrote nine of the album's eleven tracks and received co-producer credit for the entire album. Michael jackson's mom reported missing /Children refuse to leave Calabasas Home

Jermaine Jackson, brother of late pop singer Michael Jackson, said on Sunday that his mother, Katherine, was not missing as other relatives reported to authorities this weekend, but resting with family (Rebbie)in Arizona on "doctor's advice."

Katherine Jackson, 82, was reported missing by relatives on Saturday and her granddaughter Paris also posted on Twitter, "yes, my grandmother is missing. i haven't spoken with her in a week i want her home now." Jackson's nephew, Trent, filed the report with the Los Angeles County Sheriff's Office.

The missing persons report was filed by Ribera Law Firm "out of concern for Mrs. Jackson's well-being and in an effort to ensure her being safely reunited with her grandchildren as soon as possible," lawyer Sandra L. Ribera said in an email to Reuters.

Ribera said "concerned family members, particularly Michael's children, have since made ongoing pleas to those believed to have knowledge of (Katherine's) location for information regarding her whereabouts. This is not the first time the younger Jackson children have had a public miscommunication with their elder relatives.

Last week, Paris Jackson, 14, became embroiled in a war of words with her uncle, Randy, after he and his siblings said Katherine had suffered a "mini-stroke" in an undated letter to John Branca and John McClain, the executors of their late brother's estate.

The letter, leaked online to celebrity news outlet Celebuzz and verified by Randy on Twitter, was signed by Jackson siblings Tito, Randy, Jermaine, Janet and Rebbie, and claimed that Branca and McClain presented a fraudulent will of the late singer to the family and their actions were affecting Katherine's health.

The police had to be called later to the house because of an altercation ( Sheriff's deputies responded to an alleged battery there on Monday afternoon)

Randy was telling Prince Michael he had to leave with them and that he had a private jet chartered to take them all to Arizona to see Katherine. Prince firmly held his ground and told Randy he wasn't going anywhere with them. The security detail prevented the three of them from taking the kids out of state. The cops had to be called and Janet kept saying they had a legal right to be at the house when in fact they don't. The rental house is in the name of Michael Jackson's estate, so they were told to leave immediately. For the time being, they won't be allowed to come back to the rental house and guards at the security gate have been told under no circumstances are they to allow them in. Paris was absolutely hysterical and kept telling her uncles to just bring her grandmother home..

Michael's children are being cared for by their nanny and legal options are being explored about ensuring their safety. The children are very, very smart and they are surrounded by excellent bodyguards that won't allow anything unsavory to happen to them. The kids just want their grandmother back, and want the family drama to end. Now that Paris and Prince are old enough, they probably understand why Michael didn't have much of a relationship with anyone in the family except for Katherine," the source says.

If the Jacksons have real evidence that the Will is fake or that the executors are not doing their job, they should just go and attack it in court, if not they should just end up this stupid rumors and focus on what is important: the kids. While they are disputting over money, it looks like Michael children are alone and this is really not what Michael wanted!

Authorities got involved when Kathrine's nephew Trent filed a missing person report with the sheriff's office over the weekend. Siblings Janet, Jermaine and Randy Jackson attempted to persuade the older children, Prince and Paris, to leave Katherine Jackson's home with them Monday. Paris and Prince resisted.

A video shows Janet Jackson apparently trying to take a cell phone away from Paris and scolding her niece for using her phone to write about family issues on Twitter.Meanwhile, 15-year-old Prince is seen walking away from his Uncle Randy into the home's security office. Paris soon followed, and Randy and Janet Jackson appeared to be recording the incident with their cell phones.

Minutes later, sheriff's deputies broke up a scuffle involving Randy and Jermaine Jackson and Trent Jackson. No one was arrested, although a battery report was taken and an investigation is ongoing.

A judge appointed TJ Jackson, the 34-year-old son of Tito Jackson, as temporary guardian of Michael Jackson's three children in the absence of their grandmother, Katherine Jackson.

The judge ordered "that the children not be removed from California without a court order, by any person."

The judge also ordered that Diana Ross, whom Michael Jackson named as backup guardian in his will, and Debbie Rowe, the biological mother of the two oldest children, be given notice of the order.

Immediately after the hearing however, another attorney for Jackson, Perry Sanders, said he had been told by Randy Jackson that his mother was on her way back to California.

Katherine Jackson's attorney says he has met with her and she is doing well.

As I am sure everyone is well aware of the events that have been going on. I have been holding off on backing up my sister and her tweets avidly because I was waiting for the time to reveal my side. More than three years after his untimely death, Michael Jackson continues to make headlines—most recently as a result of a controversy over his will this summer. A few of his siblings labeled the document “false” and “fraudulent”; representatives for his estate countered by saying, “We are saddened that false and defamatory accusations grounded in stale Internet conspiracy theories are now being made by certain members of Michael’s family whom he chose to leave out of his will.”

Unfortunately for news hounds, the scandalous truth about Michael Jackson’s will is that there isn’t really much of a scandal, from a legal perspective. Last week FORBES obtained a copy of the latest will from the Los Angeles Superior Court (as others have before) and separately viewed three previous versions of the will, all of which are remarkably consistent and serve to confirm the boring reality: The will is in no real danger of being overturned, and even if it were, it would be replaced by a virtually identical previous version.

“If a later will is found to be invalid … the last will prior would be given full force and effect,” confirms Andrew Katzenstein, a partner at law firm Proskauer, who teaches the Estate and Gift Tax class at the University of Southern California.

Michael Jackson’s postmortem plans haven’t changed much over the years. His 1995 will names John Branca, Bert Mitchell and Marshall Gelfand as co-executors.Like all subsequent versions of the will, it specifies that the King of Pop’s interests be placed in an entity known as the Michael Jackson Family Trust, which stipulates the following distribution: 20% to charity, and the remainder split between a living will for Michael’s mother, Katherine Jackson, and a trust for any children Michael might have. Upon Katherine’s death, any remaining funds would revert to the children.

The second will, dated December 10th, 1997, also names Branca and Mitchell as co-executors of Michael Jackson’s estate, but replaces Marshall Gelfand with banker Jane Heller. The distribution under the trust remains the same. Michael’s first child—Prince Michael Joseph Jackson, Jr., born on in February—is mentioned by name, but the will still stipulates that half of what’s left after distributions to charities and Katherine Jackson be split between all children he might have.

The third, signed in March 2002, after the birth of Michael’s second and third children—Paris Michael Katherine Jackson and Prince Michael Joseph Jackson, II (better known by his nickname, “Blanket”)—identifies only the first two children by name, but still indicates that the trust would benefit all his children evenly. Perhaps just to be safe, a fourth will that names all three children was filed the following July.

Jackson’s siblings have said that the singer was in New York on July 7th, the day the fourth will was dated and marked as signed in Los Angeles. Others have confirmed that the King of Pop was in the Big Apple that day. But under California law, this isn’t something that would render the will invalid, as it’s possible the document was simply misdated.

“If you accidentally write the wrong date on a document, does it matter? No,” says Katzenstein. “There’s no dating requirement.”

The will was admitted to probate in 2009, and Katzenstein points out that California Probate Code Section 8270 stipulates a period of 120 days to file a petition with the court to revoke the probate of the will. That period has long since passed. The will’s witnesses have all confirmed the document’s validity–according to estate attorney Paul Gordon Hoffman, the individuals were contacted in the days after Michael Jackson’s death, and none indicated that their signatures were false.

Even if the most recent will–or the three most recent wills–was somehow overturned, the outcome would be the same: John Branca, who is named as an executor on all four, would still be one of the executors; 20% of all proceeds from the estate would go to charity, with the remainder split between Katherine Jackson and a trust for Michael’s children. If all four wills were invalidated, the children would inherit the estate at age 18, with Katherine Jackson and the charities left out. In theory, a more recent will could supersede the current will if discovered, but it seems highly unlikely that someone would have waited so long to come forward.

“It isn’t like someone who knew Michael, and thus would be in possession of his will, didn’t know about Michael’s death and thus is still holding it,” says Hoffman, who points out that none of Jackson’s many former lawyers or business managers knows of a more recent will. “No one has ever indicated that a later will was signed.”

But this is all essentially old news. Michael’s father Joseph, who was left out of the most recent will (and the three preceding wills), unsuccessfully challenged the will in the months following his son’s death. “Joe Jackson takes none of this estate,” declared Judge Mitchell Beckloff in 2009. “This is a decision his son made.” Beckloff formally appointed Branca and McClain as co-executors of the estate shortly thereafter, when Katherine Jackson dropped her initial objections and announced her support for their appointment.

In hindsight, that seems to have been a wise decision. The estate has generated roughly half a billion dollars in the three years since the King of Pop’s death, thanks to a slew of deals including a $60 million advance for the film This Is It, a new recording contract worth up to $250 million and the Michael Jackson Immortal World Tour, a joint venture with Cirque du Soleil that has already grossed over $75 million in the first half of 2012 according to Pollstar, more than any other North American concert tour.

In total, Michael Jackson has earned more in the past three years than any single living artist–yet another reason it would be hard to imagine the structure of his estate changing anytime soon.

Yes, there is a matching right that Michael granted to Sony/ATV but they only get to administer the catalog for a limited term AND only if they agree to unprecedented favorable terms. We will not relinquish ultimate control and ownership to anyone. We have favorably refinanced the loans on Mijac which will be paid off and the catalog WILL absolutely be passed to Michael's children as long as we have anything to say about it.

Sony/ATV is a great company and the Estate owns half of it but no one, not even Sony/ATV, will ever own Mijac while John McClain and I remain in charge.

The current Sony team is the one Michael chose to work with on the Thriller 25 release and they are good partners. As stated in the recent court filings, they worked with us to refinance the burdensome debt that had been placed on Michael's interest in Sony/ATV to very favorable terms, an important achievement which insures that Mijac and Michael’s masters remain secure for the benefit of Michael's children for years to come.

Info about the Estate and the current financial situation

Michael Jackson Estate is under probate.

Probate in layman's terms is the process of first paying the debts of the deceased and then distributing the assets to the beneficiaries.

MJ Estate is still working on paying the debts and believes they request at least one more year.

Q- Why are the beneficiaries being paid an allowance?

Because the law requires first the debts to be paid. Beneficiaries can only get the assets after the debts are satisfied

Q - How is the allowance is determined?

It's determined by a court on a need basis.

Q- What is court's role on this probate?

A judge is overseeing this process. Estate is reporting their accounting to the court and some decisions require court approval as well.

Can Katherine get information about what Estate is doing?

Absolutely. Estate is required to give her notice and basic information. She can also ask for detailed information - just as her lawyer currently have an ongoing motion to examine the accounting of MJ Estate.

Q - How much money did MJ Estate earned?

Per Estate Accounting filed with the court , they generated $475 Million in gross earnings as of July 2012.

Q - Didn't Billboard reported a $1 Billion number? What was that?

That was an estimation done by Billboard based on long term value of the deals and full prices. For example Billboard calculated CD sales by using an average CD price ($10 -$12) while actually Michael's share is significantly lower. That was a long term estimation of current deals in place.

Q- If MJ Estate earned $475 Million why didn't they pay all the debts?

Because $475 M is in gross earnings not profit. Estate still has to pay their expenses, salaries, beneficiary allowances, legal fees, taxes etc. So the net income is significantly lower.

Q - How much debt MJ Estate paid?

Significant amounts. They have reported that they expected to pay personal loans by the end of 2012. So most of creditor claims has been resolved (up to $30M), debt to AEG has been paid (around $30 M) and loan on Mijac (around $70 M) is to be paid by December 2012. It seems like the only debt remaining would be loan on Sony / ATV.

Q- Why hasn't MJ Estate given any money to charity as Michael's will requires?

As mentioned as probate rules, first the debt has to be paid and only after that MJ Estate can give money to the beneficiaries including the charities. Some people have been unfairly criticizing MJ Estate without understanding the basic legal rule. I also have to note that Estate also asked the judge to allow them to set aside $30 Million for the beneficiaries - which includes charities.

Q - Why is the probate taking this long? Is this normal?

Yes it's normal. The bigger and the more complex the business affairs the longer it takes. An extreme example would be Marilyn Monroe Estate which was under probate over 30 years - due to never ending disputes.

Q- What happens after the probate is over?

Michael's will asks the assets to be transferred into two trusts. One for Katherine and one for his kids.

Q- How much money would Katherine and MJ's kids will get after the probate?

Trustees (Branca and McClain) would continue to manage the trusts.

Katherine is supposed to get whatever is necessary for her care. There's no set amount for her. It's totally determined by the trustees/ executors. Katherine will not be getting any lump sum payment or ownership of any assets.

Michael's kids is supposed to get an allowance until they are 21 years old. Trust allows them to be given money for buying a house, starting a family & business , going to school etc even they are younger than 21. When they are 21 they start getting the income, starting 30 they are starting to get the principal assets. When they are 40 , they will get the full control of the assets.

Q - Is this normal?

Yes it is. In the case of highly valuable and high income Estates, it's common practice to divide up the distribution and give the control to the children at a later age. It's all to protect the children from being taken advantage of and giving them the control at a mature age. For example Lisa Marie Presley got control over her fathers Estate when she was 35 years old.

Q- Who owns Neverland?

Michael Jackson Estate with Colony Capital. MJ Estate owns 87.5% undivided interest at Neverland.

Q- What does undivided 87.5% interest mean?

It means although MJ Estate has a higher share and Colony Capital have the minor share, they have same use rights. In other words even though Colony Capital only owns 12.5% of Neverland, they can use the 100% of the property. It also means that all the decisions has to be done collectively.

Q- I'm hearing "Save the Neverland" or "Buy Back Neverland", what are those?

Those are either a huge misconception or a scam. As I said Estate owns 87.5% undivided interest in Neverland. Neverland is also being taken care of and in real good shape. It doesn't require any saving.

Fans trying to buy Neverland is impossible. First well because it's not for sale and second Colony Capital cannot sell their share without the approval of MJ Estate. So it won't happen, unless both Colony Capital and MJ Estate decide to sell it and a judge approves it. Just don't give anyone any money to buy or save Neverland.
